These terms and conditions apply to all services offered by ProvistaMedia, based in the Algarve, Portugal. By using our services, the client agrees to the terms and conditions outlined below.
1. Definitions Provista Media:
The company providing photography and videography services. Client: Any natural or legal person who enters into an agreement with ProvistaMedia for the provision of services. Agreement: Any arrangement between ProvistaMedia and the client regarding the delivery of services.
2. Services:
Provista Media offers specialized photography and videography services, including: Real estate photography and videography. Drone footage. Social media content management and promotional videos. The nature and scope of the services are detailed in the offer and confirmation.
3. Quotes and Confirmations:
All quotes provided by Provista Media are non-binding and remain valid for 14 days, unless stated otherwise. An agreement is established once the client gives written approval of the quote or confirms the order via email. Any changes to the order after approval will be charged separately and may affect delivery times.
4. Payments
50% of the payment must be made 48 hours before the recording starts, and the remaining 50% must be paid after approval of the final product, unless otherwise agreed. If payment is not received on time, ProvistaMedia reserves the right to suspend the delivery of services until payment is made. In the event of late payment, a 5% interest on the outstanding amount may be charged for each month of delay.
5. Delivery Times and Deadlines
Provista Media aims to deliver all images and videos within 3 business days. For rush services (within 24 hours), an additional fee may apply. Delivery times are indicative and do not constitute a binding deadline. ProvistaMedia is not liable for delays caused by unforeseen circumstances.
6. Liability
Provista Media is only liable for direct damage resulting from attributable failures in the execution of the agreement. ProvistaMedia is not liable for indirect damage, such as loss of profit, lost revenue, or reputational damage. The liability of ProvistaMedia is limited to the amount charged for the services provided.
7. Ownership and Usage Rights
The intellectual property of the delivered photos, videos, and other media remains with Provista Media, unless otherwise agreed. The client receives a non-exclusive right to use the delivered material, solely for their own commercial purposes. It is not permitted to resell, modify, or otherwise use the images without prior written consent from ProvistaMedia.
8. Cancellation Policy
The provisions in our Cancellation Policy, as described above, apply to all cancellations.
We kindly ask all clients to carefully review our cancellation policy prior to booking. This policy outlines important details regarding cancellations, rescheduling, and associated fees, ensuring transparency and clarity for both parties.

9. Privacy and Data Protection
Provista Media respects the privacy of its clients and will only use personal data for the execution of the agreement. We process data in accordance with applicable European data protection laws (GDPR).
10. Disputes
All agreements are governed by Portuguese law. Disputes arising from or related to this agreement will be submitted to the competent court in Faro, Portugal.
11. Changes to Terms and Conditions
Provista Media reserves the right to amend these terms and conditions at any time. The client will be informed of any changes in a timely manner.
At Provista Media, we understand that plans can change. Our goal is to offer flexibility while ensuring the efficient operation of our services. Please review our cancellation policy below.

If our team arrives at the property and is unable to begin the shoot due to client unavailability or lack of property access, it will be considered a last-minute cancellation. In this case, 50% of the agreed service fee will be charged.

For outdoor shoots, such as drone videos, weather conditions may require rescheduling. In such cases, we will work with you to find the next available date without incurring any cancellation or rescheduling fees.
5. Refunds
Refunds for cancellations or rescheduled appointments will be processed within 5 business days to the original method of payment.
6. Exceptional Circumstances
In the event of unavoidable or emergency situations, we encourage clients to contact us as soon as possible. We will evaluate such cases on an individual basis and may waive fees at our discretion.
